MERAKAN LITE — DMCA & COPYRIGHT POLICY
Effective Date: 15 October 2026
Version 2026-10-15
This DMCA & Copyright Policy describes the procedures used by MERAKAN LLC, a Wyoming limited liability company (“MERAKAN,” “we,” “us,” or “our”), for addressing copyright infringement claims involving MERAKAN Lite (“Service”).
This Policy should be read with the Terms & Conditions, Acceptable Use Policy, Privacy Policy, and other applicable MERAKAN policies. It does not constitute a final adjudication of copyright ownership, infringement, fair use, licensing, or other disputed rights.
1. Respect for Copyright
MERAKAN respects the intellectual property rights of copyright owners and expects Customers and users of the Service to do the same.
Customers must not use MERAKAN Lite to knowingly upload, process, store, distribute, reproduce, or otherwise make available copyrighted material without the necessary rights, authorization, license, or other lawful basis.
Customers are responsible for ensuring that they have the necessary rights to submit materials to the Service.
2. Scope of This Policy
This Policy applies to copyright complaints concerning material that is stored, uploaded, transmitted, processed, or otherwise made available through MERAKAN Lite where the applicable legal requirements are satisfied.
Privacy and Content Access:
- Content in MERAKAN Lite is private to the business account that uploads it and is not accessible to other customers or to the public.
- The application has no public pages that display customer content and no feature for sharing or distributing files.
- In the application, an image is displayed through a link issued only to a signed-in user of that account after a permission check, and the link expires after five minutes.
- Images are otherwise processed only on Google Cloud for storage, backup, and AI extraction.
Limitations of MERAKAN's Role:
This Policy does not determine whether a particular use is ultimately infringing. MERAKAN does not act as a court or final adjudicator of such disputes. Copyright disputes may involve issues such as:
- ownership;
- authorization;
- licensing;
- fair use;
- public domain status;
- contractual rights;
- other legal exceptions; or
- other defenses available under applicable law.
3. DMCA Designated Agent
MERAKAN has designated an agent to receive notifications of claimed copyright infringement under 17 U.S.C. § 512.
DMCA Designated Agent: Ahmad Almusalam
MERAKAN LLC — Registered Office: 30 N Gould St Ste R, Sheridan, WY 82801, United States
Email: store@merakan.com
Phone: +1 307-381-8088
DMCA Designated Agent Registration No.: DMCA-1081799
MERAKAN intends to keep the public website designation and the U.S. Copyright Office designation current and to renew or update the designation as required by 37 C.F.R. § 201.38.
4. DMCA Notice Requirements
A copyright owner or authorized representative who believes that material available through the Service infringes copyright may submit a written DMCA notification to MERAKAN's designated agent.
A notification should contain substantially the information required under applicable law, including:
1. identification of the copyrighted work claimed to have been infringed, or, if multiple works are involved, a representative list of those works;
2. identification of the material that is claimed to be infringing and information reasonably sufficient to permit MERAKAN to locate the material;
3. information reasonably sufficient to permit MERAKAN to contact the complaining party, such as a name, address, telephone number, and email address where available;
4. a statement that the complaining party has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
5. a statement that the information in the notification is accurate and, under applicable law, made under penalty of perjury, and that the complaining party is authorized to act on behalf of the copyright owner where applicable; and
6. the physical or electronic signature of the copyright owner or an authorized representative.
A notice that does not contain sufficient information may delay MERAKAN's ability to evaluate or act upon the complaint.
5. Where to Send a DMCA Notice
DMCA notices should be sent to:
Email: store@merakan.com
A notice may also be sent by mail to:
MERAKAN LLC
Attn: DMCA Designated Agent
30 N Gould St Ste R
Sheridan, WY 82801
United States
Using the designated-agent contact information helps ensure that the complaint is directed to the appropriate channel.
6. Processing of Valid Notices
Upon receipt of a notification that substantially complies with 17 U.S.C. § 512(c)(3), and where the § 512 safe-harbor procedure applies, MERAKAN will act expeditiously to remove or disable access to the material identified in the notice, subject to applicable law.
MERAKAN may also:
- review the notification;
- determine whether the identified material can be located;
- restrict or remove access to material identified in a notice that does not substantially comply, where appropriate;
- notify the affected Customer or user where appropriate;
- provide information concerning the applicable process; and
- take other action permitted or required by applicable law.
MERAKAN may act in good faith based on the information reasonably available at the time.
7. No Requirement to Adjudicate Ownership
MERAKAN generally does not determine disputed questions of copyright ownership, fair use, licensing, or ultimate infringement.
Where the facts are disputed, the parties may need to resolve the matter directly or through an appropriate legal proceeding.
MERAKAN may take temporary measures while a dispute is being addressed where permitted by applicable law.
8. Notification to the Affected Customer
Where appropriate and legally permitted, MERAKAN may notify the Customer or user whose material has been removed or disabled.
The notification may include information concerning:
- the nature of the complaint;
- the material identified;
- the action taken; and
- the applicable counter-notification process.
MERAKAN may withhold information where disclosure is prohibited by law or where disclosure would create a material legal, security, or privacy concern.
9. Counter-Notification
A subscriber whose material was removed or disabled following a DMCA notice may submit a written counter-notification to MERAKAN’s designated agent. To be effective under 17 U.S.C. § 512(g), the counter-notification must substantially include:
1. the physical or electronic signature of the subscriber;
2. identification of the material that was removed or disabled and the location at which it appeared before removal or disabling;
3. a statement under penalty of perjury that the subscriber has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
4. the subscriber’s name, address, and telephone number;
5. a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which the subscriber’s address is located, or, if the address is outside the United States, for any judicial district in which MERAKAN may be found; and
6. a statement that the subscriber will accept service of process from the person who submitted the original notification or that person’s agent.
Counter-notifications should be sent to store@merakan.com. MERAKAN may forward a valid counter-notification to the original complaining party as contemplated by law.
10. Restoration Following Counter-Notification
After receiving a qualifying counter-notification, MERAKAN will promptly provide a copy to the person who submitted the original notice and inform that person that the material may be restored in 10 business days.
Subject to 17 U.S.C. § 512(g), MERAKAN will restore the removed material or cease disabling access not less than 10 and not more than 14 business days after receipt of the counter-notification, unless the designated agent first receives notice that the complaining party has filed an action seeking a court order to restrain the subscriber from engaging in the allegedly infringing activity.
11. Repeat Infringers
MERAKAN has adopted and will reasonably implement a policy providing for termination, in appropriate circumstances, of Customers or users who are repeat infringers, consistent with 17 U.S.C. § 512(i).
In applying the policy, MERAKAN may consider valid notices, material removed or disabled, repeated infringing conduct after notice, red-flag knowledge, counter-notifications, court outcomes where known, and other relevant facts. MERAKAN may use reasonable judgment and will not treat a single unresolved allegation as automatically establishing repeat infringement.
12. False or Misleading Notices
Submitting a knowingly false or materially misleading copyright notification or counter-notification may have legal consequences.
A person submitting a notice or counter-notification should ensure that the information provided is accurate and that the person has the necessary authority.
MERAKAN may take appropriate action concerning abuse of the copyright-notice process.
Applicable law may provide remedies for material misrepresentations made in connection with DMCA notices or counter-notifications.
13. Customer Responsibility
Customers are responsible for ensuring that materials submitted to MERAKAN do not knowingly infringe third-party copyright.
Customers must maintain appropriate rights, licenses, permissions, or other legal authorization for materials they submit.
This responsibility includes materials contained within:
- invoices;
- receipts;
- images;
- documents;
- logos;
- photographs;
- designs; or
- other Customer-submitted content.
14. Customer Content and Copyright
As between MERAKAN and the Customer, the Customer retains its rights in Customer Data and Customer Content subject to the rights granted to MERAKAN under the Terms.
The Customer's ownership of its content does not authorize the Customer to submit material belonging to another party without the necessary rights.
MERAKAN's processing of Customer Content does not transfer copyright ownership to MERAKAN.
15. MERAKAN Intellectual Property
The MERAKAN Service, including its software, interface, branding, design, documentation, systems, and other proprietary materials, is owned by or licensed to MERAKAN and is protected by applicable intellectual-property laws.
Except as expressly permitted by the Terms, Customers do not receive ownership of MERAKAN's intellectual property.
Nothing in this Policy grants a license to use MERAKAN trademarks, logos, software, or other proprietary materials.
16. Other Intellectual Property Complaints
This Policy primarily addresses copyright complaints.
Complaints concerning:
- trademarks;
- patents;
- trade secrets;
- publicity rights;
- privacy rights;
- contractual rights; or
- other intellectual-property or legal rights
may require a different process.
Such complaints may be sent to store@merakan.com with sufficient information to identify the issue.
MERAKAN may determine the appropriate process based on the nature of the complaint and applicable law.
17. Third-Party Material
MERAKAN may process or store material submitted by Customers.
MERAKAN does not necessarily review all Customer Content before it is processed.
The presence of material within the Service does not mean that MERAKAN has independently verified ownership, authorization, legality, or non-infringement.
18. Good-Faith Enforcement
MERAKAN may remove, restrict, or disable access to material in good faith where it reasonably believes that doing so is appropriate under applicable law or the contractual framework.
Subject to Section 6, MERAKAN may also decline to take action where a complaint is incomplete, unsupported, outside the scope of this Policy, or otherwise does not provide a sufficient basis for action. Where a notification does not substantially comply with all the requirements of 17 U.S.C. § 512(c)(3)(A) but substantially identifies the copyrighted work, the material claimed to be infringing with information reasonably sufficient to locate it, and the complaining party’s contact information, MERAKAN will promptly attempt to contact the complaining party or take other reasonable steps to assist in the receipt of a notification that substantially complies with all those requirements.
19. No Guarantee of Safe-Harbor Protection
This Policy is intended to support MERAKAN’s compliance with the notice-and-takedown framework and other conditions that may be relevant to safe-harbor protection under 17 U.S.C. § 512.
MERAKAN does not guarantee that it will qualify for a statutory safe harbor in every circumstance. Eligibility depends on the applicable statutory category, MERAKAN’s conduct, reasonable implementation of the repeat-infringer policy, accommodation of standard technical measures, maintenance of a valid designated agent, and other statutory conditions.
20. Privacy
MERAKAN may process personal information contained in copyright notifications and counter-notifications for purposes including:
- evaluating copyright complaints;
- communicating with the parties;
- administering the DMCA process;
- complying with legal obligations;
- maintaining legal records; and
- protecting MERAKAN's rights.
Such information will be handled according to the MERAKAN Privacy Policy and applicable law.
21. Legal Process
Nothing in this Policy prevents MERAKAN from responding to:
- subpoenas;
- court orders;
- governmental requests;
- law-enforcement requests;
- other legally binding processes; or
- other obligations imposed by applicable law.
MERAKAN may disclose information where legally required or otherwise permitted.
22. No Independent Adjudication
MERAKAN is not a court and generally does not make final determinations concerning:
- copyright ownership;
- infringement;
- fair use;
- licensing;
- damages; or
- other disputed legal rights.
MERAKAN may nevertheless take reasonable interim action consistent with its legal obligations and contractual rights.
23. Relationship to Other Documents
This Policy forms part of the MERAKAN Lite contractual framework.
If there is a conflict between this Policy and another MERAKAN document concerning copyright-notice procedures:
1. mandatory applicable law controls;
2. an expressly negotiated written agreement controls where applicable; and
3. this Policy controls for MERAKAN's internal copyright-notice procedures.
The Terms continue to govern matters not specifically addressed by this Policy.
24. Changes to This Policy
MERAKAN may update this Policy to reflect changes in law, Service functionality, copyright procedures, designated-agent information, or legitimate operational requirements.
MERAKAN will maintain the currency and accuracy of its designated-agent information on its public service and with the U.S. Copyright Office, and will timely amend or renew the designation as required by 37 C.F.R. § 201.38.
25. Severability
If any provision of this Policy is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
26. Governing Law and Disputes
This Policy is governed by the same governing-law, dispute-resolution, arbitration, class-action waiver, and related provisions stated in the MERAKAN Lite Terms & Conditions, except to the extent mandatory applicable law requires otherwise.
Nothing in this Section limits rights, statutory procedures, or remedies that cannot lawfully be waived.
